Cass left public defense in 2020 and has been doing private criminal defense, civil rights litigation, civil litigation, breach of contract and other business-related litigation ever since.
Cass lives in West Tisbury, MA with his wife and is proud to bring his expertise to the Cape and Islands community.
Relevant Experience
Criminal Law
Any criminal case is sufficiently serious that a criminal law specialist is needed. Cass has defended hundreds of criminal cases, ranging from low level misdemeanors such as misdemeanor assaults or drug possession cases, all the way up to rapes, robberies and murders. Cass started as a defense investigator in Washington D.C. where he worked for two years before attending law school. While in school he participated in clinical programs, representing clients in Boston-area municipal courts. After graduation, he became a public defender in Louisiana, and soon became chief public defender for Vermillion Parish (County) where he supervised numerous attorneys and support staff. After four years in Louisiana, he moved to New York City and worked as a trial and senior trial attorney at Brooklyn Defender Services for two more years. Cass has been deeply involved in criminal defense work in various capacities for over a decade.
Civil Rights Lawsuits
Civil cases for police misconduct revolve around the facts of criminal cases and therefore require attorneys with experience in both worlds. Cass has worked on hundreds of civil rights cases, and has experience as a plaintiff-side attorney in state and federal lawsuits regarding false arrest, denial of the right to a fair trial, and excessive force claims against state and local authorities.
Operating Under the Influence
Operating Under the Influence cases, called OUIs in Massachusetts, involve not only criminal penalties such as probation or incarceration, but also civil penalties such as the loss of one's license. On the criminal side, Cass has represented hundreds of clients charged with driving while under the influence of alcohol or drugs, litigating issues involving invalid car stops, unreliable breathalyzers, and suppression of evidence generally. On the civil side, Cass has successfully appeared numerous times at DMV/RMV hearings to ensure his clients keep their driver's licenses and endorsement.
Civil Litigation
Cass has tried civil cases, including breach of contract and 93A claims, in both District and Superior Court in Massachusetts. He has experience with Massachusetts law on Home Improvement Contractors found in 142A as well as preparing demand letters, drafting and filing complaints, retaining experts, and presenting a business's case at trial.
Training and Education
Cass graduated from Harvard Law School and was trained by the prestigious Gideon's Promise organization, an award-winning criminal defense attorney instructional program that trains a select few public defenders annually. Over his years of practice, Cass has tried numerous cases in multiple states, both civil and criminal, and receives continued training every year.
Business Law and Contracts
Cass has extensive experience in representing with a consulting company with numerous interlocking international contracts, service agreements, non-disclosure agreements, and employment contracts.
